The “WSPA
Dream Wedding Giveaway Contest” (the “Contest”) is sponsored by Media General
Communications Holdings LLC d/b/a WSPA-TV (“WSPA”), GSP Bridal Network, Carolina
Traditions, All Occasions Celebrations, Upcountry History Museum, Grace Hall, Frilly
Bloomers, Signature of Elegance, Art Eats Bakery, The Buttercream Bakehouse, Skatells
of Spartanburg, Cruise One, Bed & Breakfast on Tiffany Hill, Carolina
Mountain Vacations, Carolina Party Professionals, Sara Theisen Design, Carri
Bass Photography, Glamour Obsession Beauty Studio, Everything for Weddings, Expressions Flowers, Couture Cakes, Reeves
Catering and Better Tie
Productions (collectively “Sponsors”).
NO PURCHASE
NECESSARY. Void where prohibited or restricted by applicable federal or state
laws and regulations. The Contest begins on April 1, 2011 and ends
on June 20, 2011 (the Promotion Period”).
Completion
of an entry form by entrant constitutes an agreement by that entrant to be
bound by these Official Rules and by the decisions of the WSPA and Contest
Judges, whose decisions are final. Failure to comply with these Official Rules may
result in disqualification. WSPA reserves the right to disqualify any entrant it
believes, in its sole discretion, has intentionally, knowingly or materially violated
these Official Rules.
I. INTRODUCTION
WSPA is
giving a Grand Prize to an engaged couple (“the Wedding Couple”) who will be
judged and selected by WSPA, a panel of independent judges (“Contest Judges”)
and public voters. The wedding will take place at the venue selected by public
voters, to be supplied by either All Occasions Celebrations, Upcountry History
Museum or Grace Hall and, in WSPA’s sole discretion, may be videotaped for subsequent
broadcast on a date and time to be chosen by WSPA, without further compensation
to the Wedding Couple. Prizes are described in greater detail below. Anyone
considering submitting an entry to participate in this Contest should read all
of the information below for eligibility rules, requirements of participation
and an explanation of what the Wedding Couple will receive. Please note that
all entrants must be willing to, among other things:
Complete an entry form with all required information and
submit a photo of the entrant couple on http://wspa.upickem.net/engine/Welcome.aspx?contestid=28383;
If selected as a Finalist, allow WSPA to conduct a
background check on you and make yourself available to be interviewed and
videotaped by WSPA on May 2, 2011 at WSPA’s main studio, located at the Michelin on Main Studio - 550 S. Main St., Greenville, SC, 29601.
If selected as the Wedding Couple, to make yourselves
available for multiple appearances on WSPA and for related publicity and
promotions, to accept the decisions of WSPA and voters on http://wspa.upickem.net/engine/Details.aspx?PageType=VOTING&contestid=28383
regarding the prize elements (described in greater detail below), without input
from the Wedding Couple, and to be married at the venue selected by public
voters, to be supplied either by All Occasions Celebrations, Upcountry History
Museum or Grace Hall and which ceremony may, in WSPA’s sole discretion, be
videotaped for subsequent broadcast on a date and time to be chosen by WSPA,
without further compensation to the Wedding Couple.
The
requirements detailed in these Official Rules cannot be waived or changed
except by WSPA, and entrants who cannot perform these requirements or make the
necessary time commitment, or whose religion does not permit a marriage outside
of a religious dwelling, should not submit an entry form.
This
Contest is executed on http://wspa.upickem.net/engine/Welcome.aspx?contestid=28383
and consists of the
following four (4) phases:
- The Entry
Phase of the Contest begins on April 1, 2011 at 5:01 a.m. and ends on April
24, 2011 at 11:59 p.m. Eastern Time (“ET”).
- The Panel
Judging Phase of the Contest will take place on April 25, 2011, during
which time the three (3) Finalists will be selected by the Contest Judges
(defined below) and announced on May 2, 2011, or within a reasonable time
thereafter.
- The
Public Voting Phase will begin on May 2, 2011 and end on or about May 6,
2011, during which time viewers will have a chance to vote for their
favorite Finalist Couple. The Wedding Couple will be determined based on
a combination of the scores received from the Contest Judges during the
Judging Phase (40%) and the results of the Public Voting Phase (60%) and
will be announced on May 9, 2011, or within a reasonable time thereafter.
- The Wedding
Elements Selection Phase of the Contest will begin on or about May 9, 2011
and end on or about June 17, 2011.
WSPA’s
computer is the official time-keeping device for this Contest.
II. ELIGIBILITY CRITERIA
To be
eligible to participate or to receive a prize, entrants must meet the following
eligibility requirements at all times during the Promotion Period:

each couple
submitting a completed entry form must consist of a male and a female, each of
whom is at least eighteen (18) years of age as of April 1, 2011;
·
the couple must
have been engaged to be married to each other for at least one (1) month prior
to April 1, 2011 and must remain engaged to each other throughout the Promotion
Period;
·
each individual
must be a legal resident of North Carolina or South Carolina;
·
neither individual
can be subject to any travel restrictions and must agree to obtain the
requisite travel-related immunizations, if necessary;
·
each individual
must be of good moral character, neither individual can have been convicted of
a crime of any nature (other than moving violations of a misdemeanor type that
did not involve personal injury, drugs or alcohol) or have anything in his/her background
that would be an embarrassment to WSPA, as determined by WSPA in its sole
discretion;
·
if selected as a
Finalist Couple, each couple must be willing to undergo a background check
conducted by WSPA in its sole discretion, and to sign waiver forms authorizing
the release of personal and background information to WSPA for that purpose and
to cooperate in WSPA’s verification of the truth of any statements made in the
Submission Materials;
·
if selected as
the Wedding Couple, each couple must be willing to have his/her wedding
ceremony performed at the venue selected by public voters, to be supplied by
either All Occasions Celebrations, Upcountry History Museum or Grace Hall;
·
neither individual
can be an elected official or be running for any political office (local, state
or federal) during the Promotion Period; and
·
each individual must
be willing to sign an affidavit attesting to the truth of the facts in the Submission
Materials and attesting that each individual meets all the eligibility
requirements.
·
neither
individual can be an employee, officer, director or contractor of Sponsors, or
of any other company or entity engaged in the development of, the production or
distribution of materials for, or the implementation of this Contest, any contributing wedding partner
organization(s), and their respective advertising and promotion agencies, their
parent, subsidiary and joint venture companies, or a member of the immediate family (defined as
spouse, parents, siblings or children) or household (whether or not related) of
any such employees or contractors.
III. PRIZE/PRIZE RESTRICTIONS
A. Grand Prize Description: Grand Prize has an approximate
retail value of between $9,493.0.00 and $11,651.00, and will consist of (1) the
Wedding Elements selected by public voters during the Wedding Element Selection
Phase; and (2) the Non-Voting Prizes. The ARV of the Grand Prize will vary,
depending on a number of factors, including the particular Wedding Elements
selected by public voters during the Wedding Element Selection Phase, dates
selected by Wedding Couple for their ceremony and other market factors.
1. Publicly-Selected Wedding Elements: The
Wedding Elements to be selected by public voters during the Wedding Element
Selection Phase consist only of the following:

Wedding Apparel: A wedding gown for the bride, including
headpiece with an ARV up to $900.00, and a tuxedo rental for the groom
including shirt, tie, vest, shoes and studs and cuff links with an ARV up to
$150.00, provided by Carolina Traditions, and which must be redeemed and used
in their entirety by Wedding Couple no later than October 31, 2011. ARV of
wedding apparel will depend on the selections by viewers during week #1 of the
Wedding Elements Selection Phase. Wedding apparel does not include alterations.
·
Venue: Venue for the wedding ceremony
officiated at a wedding location supplied by either:
o
All Occasions
Celebrations (includes use of the venue building on any day except Saturday; ceremony
must be booked and completed no later than October 31, 2011), or
o
Upcountry
History Museum (includes access to lobby/first floor of museum for up to 150
guests between 5:00 p.m. Friday and 1:00 p.m. Sunday, 15 banquet tables, 6 cocktail
tables, and 80 chairs; ceremony must be booked and completed no later than
October 31, 2011), or
o
Grace Hall (includes
access to 6,000 ft space for full Friday, tables, chairs, access to stage area,
A/V system, and decorative window, and up to two (2) hour consultation;
ceremony must be booked and completed no later than October 31, 2011),
on a date to be mutually agreed by the venue provider and
Wedding Couple, subject to availability, with an ARV between $1,400.00 and $2,200.00,
depending on the venue and other selections by viewers during Week #2 of the
Wedding Elements Selection Phase. Venue provider may require Wedding Couple to
sign standard lease or rental or license agreement and pay refundable damage
deposit. Wedding Couple must agree to follow venue rules and requirements for
event, including restrictions on smoking, open flames, alcohol, caterers, and
other limitations. Consult venue provider for more information;
·
Flowers: A bouquet for the bride and a
boutonnière or the groom, provided by either Frilly Bloomers, Signature of
Elegance or Expressions Flowers, to be selected by viewers during week #3 of
the Wedding Elements Selection Phase, with an ARV of $250.00 and which must be
redeemed no later than October 31, 2011;
·
Wedding Cake: A wedding cake provided by either Art
Eats Bakery, The Buttercream Bakehouse or Couture Cakes, including tax, set-up
and delivery, with an ARV between $600 and $750, depending on the
selections by viewers during week #4 of the Wedding Elements Selection Phase.
Wedding Cake selections and designs are subject to availability and must be
redeemed no later than October 31, 2011;
·
Rings: A wedding band for the bride and a
wedding band for the groom provided by Skatells of Spartanburg, with a combined
ARV between $398.00 and $528.00, depending on the selections by viewers during
week #5 of the Wedding Elements Selection Phase. Bride’s wedding rings are size
6; re-sizing charges may apply and prize must be redeemed no later than October
31, 2011; and
·
Honeymoon: Honeymoon provided by either
o
Cruise
One (certificate
redeemable for five (5) night cruise for Wedding Couple to Bahamas from Charleston in standard inside cabin, government
taxes/fees, and shipboard gratuities, is valid only for travel during the Fall except
for last two (2) weeks of December; and certificate must be redeemed by Wedding
Couple within eighteen (18) months from date of issuance; or
o Bed & Breakfast on
Tiffany Hill: Two (2)
nights’ accommodations at the Bed & Breakfast on Tiffany Hill,
complimentary three (3) course Gourmet Breakfast, the “Star Gazer Romance
Package,” a complimentary bottle of champagne & chocolate covered
strawberries upon arrival, two (2) admission passes to the Biltmore Estate, and
a Gift Certificate redeemable for dinner for the Wedding Couple for up to
$50. Advance reservations are required and this prize must be redeemed and used
in its entirety no later than June 30, 2012; or
o Carolina Mountain
Vacations (three (3)
nights’ accommodations for Wedding Couple in a one or two bedroom mountain
cabin plus Wedding Couple’s choice of one (1) of the following adventures: either
white water rafting on the Nantahala River or zip line across the Nantahala
Gorge; location and amenities will vary depending on date and selection and
prize is subject to Carolina Mountain Vacations policies and restrictions. See

Honeymoon element will have an ARV between $600.00 and
$1,178.00, depending on the selections by viewers during week #6 of the Wedding
Elements Selection Phase and booking dates.
Passports may be required for this prize and Wedding Couple is solely
responsible for ensuring that they have proper travel documentation.
2. Non-Publicly Selected Wedding
Elements: The Grand Prize shall also include the following elements,
which shall not be subject to the Wedding Element Selection Phase or public
voting:
- DJ
Services: Three
(3) hours of DJ services at the Wedding Couple’s wedding reception only,
provided by Carolina Party Professionals, consisting of one (1) DJ and
music, which must be booked and used no later than October 31, 2011, and
subject to availability and advance scheduling (ARV: $995.00);
- Invitations: One (1) set of custom wedding
invitations, consisting of a personalized design and printing of one
hundred and fifty (150) each of wedding invitation, response card,
response envelopes and outer envelopes, all printed in one ink color on
white or natural premium stock, provided by Sara Theisen Design. A proof
will be provided before printing order is placed. Prize must be fully
redeemed within one (1) year from date of issue. Additional colors,
quantity or custom paper choices are subject to availability and Wedding
Couple is solely responsible to pay for any such additional items. (ARV:
$600.00);
- Photography
Services: Photography
services provided by Carri Bass Photography, consisting only of one (1) Bridal Session and one (1) 16 x
20 Bridal Session Portrait and a total of three (3) hours of photography
(services only) at the wedding and same-day reception. Prize is subject
to availability and does not include any photos other than the Bridal
Session Portrait mentioned above. (ARV: $700);
- Videography
Services: Videography
services provided by Better Tie Productions consisting only of a “meet and
greet” session with Wedding Couple, a total of six (6) hours video
coverage (two (2) cameras, one (1) videographer) of wedding ceremony and
same-day reception, two (2) DVDs containing the following edited video of
wedding ceremony, wedding reception (condensed) and highlights, with custom
menu and chapters. Prize does not include raw videotape, which remains
property of Better Tie Productions. Prize may be upgraded at Wedding
Couple’s sole expense, subject to approval of Better Tie Productions. Prize
must be used in its entirety no later than October 31, 2011. (ARV: $1,900.00)
- Makeup: Bridal makeup services
provided by Glamour Obsession Beauty Studio, consisting of a consultation at Glamour
Obsession Beauty Studio, the Bride’s makeup for her Bridal Session
Portrait, a makeup trial for the Bride prior to wedding, and makeup for
the Bride on the day of the wedding, all of which must be used in their
entirety no later than October
31, 2011. (ARV: $250);
- Wedding
Decorations: Gift
certificate redeemable by Wedding Couple for up to two hundred and fifty
dollars ($250.00) in rental and decorations for their wedding ceremony,
provided by Everything
for Weddings, subject to availability, which must be redeemed and used no
later than October 31, 2011. (ARV: $250.00);
- Catering
Discount: Discount
of five hundred dollars ($500.00) on a minimum food order of at least one
thousand dollars ($1,000.00) or discount of one thousand dollars
($1,000.00) on a minimum food order of at least three thousand dollars
($3,000.00) for the Wedding Couple’s ceremony for catering services supplied
by Reeves Catering, which must be redeemed no later than October 31, 2011.
Prize includes food only; no alcohol or other beverages will be provided. (ARV:
$500-$1,000, depending on size of food order).
B. Prize Restrictions: Prizes and prize certificates are
personal to Wedding Couple and are not transferable. No substitution or cash
redemption of any Prize or any element thereof is permitted except that WSPA
may substitute prize or element of equal or greater value if it deems necessary
Only those components of the wedding described above will be provided by
Sponsors. Wedding Couple assumes sole responsibility for all costs associated
with the prizes not explicitly outlined in these Official Rules, including but
not limited to any and all federal, state and local income taxes (if any), fees,
surcharges on a prize, any and all wedding related expenses not described
above, any honeymoon expenses not described above, such as passport expenses, meals,
beverages, tips, gratuities, sightseeing, souvenirs, trip insurance,
excursions, accommodations, transportation, and incidentals. Other
restrictions apply.
Additional
or different features or options may be requested by the Wedding Couple, but
are subject to approval by the relevant prize suppliers in their discretion and
Wedding Couple shall be solely responsible for all costs or expenses related to
any such additional approved items. Additional prizes may be added in WSPA’s
sole discretion, which may increase the approximate retail value of the Grand
Prize as a whole. The Wedding Couple is not required to accept any of the
additional prizes.
Honeymoon
accommodations provider (such as hotel, cruise ship or resort, if any) may
require credit card or cash deposit for incidentals. The wedding and wedding
reception must take place within the time period designated by WSPA and the
venue supplier or Wedding Couple may forfeit the Grand Prize and the runner-up
Finalist Couple will be declared the Wedding Couple, in WSPA’s sole discretion.
Members of the wedding party and other guests invited to attend the wedding
ceremony may be required to complete a publicity release supplied by WSPA.
Sponsors
assume no liability or responsibility in connection with the safety or
performance of any portion of the Grand Prize or in connection with any
warranty or representation therewith except as provided by manufacturer.
IV. ENTRY
PHASE
Entries
will be accepted beginning on April 1, 2011 at 5:01 a.m. ET and ending on April
24, 2011 at 11:59 p.m. ET (“the Entry Period”). To enter, visit http://wspa.upickem.net/engine/YourSubmission.aspx?contestid=28383,
complete an online entry form (including answers to the questions below) and upload
a photo of the couple. If you wish, you also may include a URL for an optional
YouTube videotape of the couple. The online entry form, photo and video, if
any, and any other information you provide to WSPA relating to your entry during
the Entry Period are collectively referred to as your “Submission Materials”
and all of your Submission Materials must satisfy the “Submission Requirements”
below. Entry form will require answers to the following questions:

All entries
must be received by WSPA by 11:59 p.m. ET on April 24, 2011. Proof of sending is not proof of
receipt by WSPA. WSPA will not accept screen shots as proof of entry. WSPA is
not responsible for, and all entrants assume all risk of, entries that are lost,
misdirected, mutilated, garbled, distorted, truncated, incomplete, not legible,
if they contain errors or if for any reason they are not received by WSPA prior
to the stated deadline, and all such entries are void. Entrants who fail to
provide any of the information required above will not be eligible to win and
may not be notified by WSPA.
Limit one
(1) entry per couple. Multiple entries received from any couple or e-mail
address thereafter will void all such additional entries. Any use of robotic, repetitive,
automatic, programmed, script, macro, or any other
automated means or similar entry methods or agents (including, but not
limited to, contest-entry services) are prohibited and will void all entries
submitted by that entrant. No third party entries will be eligible; you must
enter on your own behalf and that of your fiancé/fiancée.
Sponsors
are not responsible for lost, interrupted, or unavailable network, server, or
other connections, or for any failed telephone or computer hardware or software,
or for any failed, delayed, misdirected, postage-due, illegible, mutilated,
corrupted, or garbled transmissions or errors of any kind, whether human,
mechanical, or electronic, or for entries that for any reason are not received
by WSPA by the deadline stated above. All entries, including Submission
Materials, become the property of WSPA and will not be acknowledged or
returned.
The Contest
Page is hosted by UPICKEM. The personal information that you provide in
connection with the Contest may be used by UPICKEM and WSPA in accordance with the
Contest Privacy Policy, which is found at http://wspa.upickem.net/engine/PrivacyPolicy.aspx
and which may be updated from time to time.
By entering
in this contest, you consent to receive follow-up messages from contest
sponsors with an announcement, promotion or unique offer.
A. Submission Requirements: All Submission
Materials must satisfy the following Submission Requirements:

Submission
Materials must be truthful, original to entrants (not copied, adapted, or
reproduced from any other source and not a collaboration with any other person);
·
Submission
Materials must be unpublished and must not have been submitted in any other competition);
·
Submission
materials must be written in English and text must be free of any formatting
(bold, italics, etc.);
·
Submission
Materials must not contain material that promotes bigotry, racism, hatred, or
harm against any group or individual or promotes discrimination based on race,
sex, religion, nationality, disability, sexual orientation or age;
·
Submission
Materials must not
include any text, content, photos, film or other images that were not
originally taken or created by entrant;
·
Submission
Materials must not infringe upon any rights of any third party, including but
not limited to copyright, trademark, and rights of privacy and publicity;
·
Submission
Materials must not depict any identifiable trademark or trade name;
·
Submission
Materials must not include any portrait or copyrighted photographs or videos and
must not include any watermarks, signatures, or copyright notices;
·
Videos and
Photos may not be digitally altered or enhanced, except that images may be
cropped and rotated as necessary;
·
Photos must be in
one of the following file formats: .jpg, .gif, and .tiff;
·
Any
individual whose face is shown in your Submission Materials must have
previously given you permission to use his/her image in your Submission
Materials and you must provide WSPA with written proof of his/her permission
upon request;
·
Submission
Materials must not include any music; and
·
Submission
Materials must not depict or include any profanity, obscene, adult, provocative
or otherwise inappropriate content, including but not limited to nudity.
In the
event that any claim of unauthorized use of any content contained within any Submission Materials is made to WSPA by any third party, WSPA reserves the right to immediately
terminate public access (if any) to the Submission Materials and disqualify the
related entry. In
addition, any Submission Materials that are determined
by WSPA in its sole discretion at any time
during the Promotion Period to violate the Submission Requirements or the
Official Rules, or to otherwise be unsuitable, offensive, in poor taste, or
otherwise not in keeping with WSPA’s corporate image, as
determined in the sole discretion of WSPA, may be
rejected and the accompanying entry disqualified, even if the entry has
previously been submitted for the Judging Period. WSPA retains sole discretion as to whether
any Submission Materials satisfy the Submission Requirements and its decisions
are final.
B. Warranties/Indemnity By Entrant Couple: By
submitting your Submission Materials, you warrant that both the bride-to-be and
groom-to-be have agreed to enter this Contest and that (a) the Submission Materials are
original to and were created solely by the entrant and have not been copied, in
whole or in part, from any copyrighted or proprietary works belonging to anyone
else, (b) the Submission
Materials do not
violate any copyright laws, and do not plagiarize, libel, slander, defame,
disparage, or otherwise infringe on or violate the rights of any third parties,
(c) any and all persons depicted in the Submission Materials have provided the Entrant with signed, written permission
to take or create the Submission
Materials and to submit
them in this Contest; (d) Entrant is legally entitled to submit the Submission Materials in the Contest; (e) the
distribution, reproduction, display and any other uses of the Submission Materials by WSPA as permitted herein will
not infringe any third party rights, including those of any person who is
depicted in, or whose property is depicted in, the Submission Materials; and (f) the Submission Materials comply with each of the provisions
of these Official Rules.
Each entrant agrees to indemnify and hold harmless Sponsors, their officers,
directors, employees and affiliated organizations, and their respective
officers, directors and employees, from and against any and all claims,
demands, damages, costs, liabilities and causes of action of whatsoever nature
that are based upon or arise out of any breach by the entrant of these Contest
rules or the warranties and representations made in this paragraph.
C. Not Employment Application: By submitting Submission
Materials to the “WSPA Dream Wedding Giveaway Contest,” entrants acknowledge
that they are not submitting an application for employment.
D. License To Use Submission Materials: By
entering, entrants and everyone appearing in the Submission Materials agree
that the Submission Materials may be broadcast on WSPA and published on its various
websites, including www.wspa.com and www.yourcarolina.tv and in promotions and
advertisements for WSPA and give WSPA a perpetual, worldwide, non-exclusive
license to use, reproduce, broadcast, rebroadcast and exploit such material in
any media now or hereafter discovered on www.wspa.com and www.yourcarolina.tv and any related sites in connection with the administration of this
Contest.
V. PANEL JUDGING PHASE
On or about
April 25, 2011, a panel
of independent judges consisting of various television and marketing
professionals will judge each of the entries that are timely and properly submitted at http://wspa.upickem.net/engine/Welcome.aspx?contestid=28383
during the Entry Period and select three (3)
Finalist Couples (“Finalist Couples”), including the Wedding Couple, based on
the following equally weighted criteria as determined from each couple’s Submission
Materials:

The emotional appeal
of the couple;
·
The personality
of each entrant, individually and as a couple; and
·
The likeability
of each entrant, individually and as a couple.
The
decisions of the Contest Judges are final and entrants agree to be bound by
these decisions. In the event of any tie, the tied Finalist Couples will be judged
by a new panel of independent judges, based on the same criteria identified
above, until the tie is resolved. WSPA reserves the right to select fewer than
three (3) Finalist Couples in the event that it does not receive a sufficient
number of adequate, eligible entries.
The
submission of your entry to Contest Judges for the Panel Judging Phase does not
constitute an acknowledgement or determination by WSPA that your entry
satisfies these Official Rules, including the Submission Requirements, or that
you are otherwise eligible. WSPA reserves the right, at any point during this
Contest, to refuse to submit to the Contest Judges, or to withdraw from the
Contest Judges' consideration, any entries that WSPA determines, at any time and in its sole discretion, do not satisfy all
requirements of these Official Rules.
VI. PUBLIC VOTING PHASE
A. Announcement of Finalist Couples: Subject to verification of eligibility, on May 2, 2011, or within a
reasonable time thereafter, WSPA will announce the names of the Finalist
Couples. WSPA will
contact all potential Finalist Couples in accordance with the information
supplied to WSPA on their Entry Forms. Finalist Couples may be verified over
the telephone at the time and may be required to provide WSPA with valid
identification. Acceptable identification includes a valid driver’s license or
other valid picture ID showing name and address. Finalist Couples may be required as
a condition of continued eligibility to complete and sign an Affidavit of
Eligibility, Waiver of Liability and Publicity Release provided by WSPA. Finalist
Couples may be asked to sign other documents, including tax documents. Finalist
Couples will be required to return all requested documentation within two (2)
days of notification. Faxes
will not be accepted.
In the
event that any potential Finalist Couple (a) cannot be contacted directly by WSPA
within two (2) days from initial attempted notification, (b) fails to satisfy
any eligibility or verification requirement herein, (c) declines to participate
further in the Contest, (d) or is otherwise determined to be ineligible, WSPA
in its discretion may disqualify that Finalist Couple and runner-up entrant
will be declared the alternate Finalist Couple as soon as reasonably
practicable after initial Finalist Couple is determined to be ineligible, if
time permits, in WSPA’s sole discretion. If the first runner up is not eligible, it reverts to
the second runner up and so on. Alternate Finalist Couples are subject to all eligibility
requirements and restrictions of these Official Rules.
Upon
verification of eligibility, the names of Finalist Couples may be posted on the
Contest Page at http://wspa.upickem.net/engine/Welcome.aspx?contestid=28383
and WSPA’s websites, including www.wspa.com and www.yourcarolina.tv.
B. Finalist Couple Obligations: Those entrants selected as
Finalist Couples must also be willing to undertake the following without
additional compensation:
- to be
interviewed by telephone, and to either appear in a videotape produced by
WSPA or to submit a videotape in which the Finalist Couple appears;
- to make
themselves available to be interviewed by WSPA at times, dates and
locations selected by WSPA, in WSPA’s sole discretion;
- to make
themselves available for videotaped appearances to air on WSPA, and to ask
friends and family to appear as well;
- to make
themselves exclusively available to WSPA for all other publicity and
promotion and not to allow interviews by other media outlets, including
television, magazines, newspapers, radio, and internet, unless authorized
by WSPA, from the time the Finalist Couples are announced, until after the
final on-air appearance by the Wedding Couple.
- In WSPA’s
sole discretion, the Finalist Couples may also be subject to background
checks to verify eligibility and determine additional information about
any of the individuals.
C. Public Voting: The Submission Materials
for the three Finalist Couples will be posted to http://wspa.upickem.net/engine/Details.aspx?PageType=VOTING&contestid=28383
for public voting from
May 2, 2011 at 10:00 a.m. ET until May 6, 2011 at 12:01 p.m. ET. During the Public Voting Phase, any visitors to http://wspa.upickem.net/engine/Details.aspx?PageType=VOTING&contestid=28383 (including Entrants) (collectively
referred to as “Voters”) may view the Submission Materials and other
information relating to the Finalist Couples and vote for their choice for the Wedding Couple. In the
event of a tie, public voting will be extended for additional twenty-four (24)
hour voting periods until the tie is resolved. The results of the public
voting will constitute sixty percent (60%) of the score used by the Contest
Judges to select the Wedding Couple.
Voters must
be at least thirteen (13) years old or older and must register in order to
vote. Registration requires each Voter to supply his/her name, e-mail address,
age, gender, and acknowledge agreement to the applicable web site terms and
conditions and these Official Rules. Voting is limited to one (1) vote per IP
address per day. Any use of robotic,
repetitive, automatic, programmed, script, macro, or
any other automated means or similar entry methods or agents to vote are
prohibited and will void all votes submitted by that Voter.
WSPA reserves the right to disqualify
any votes that it reasonably believes to have been fraudulently cast. WSPA reserves the right to cancel, terminate or suspend
this Public Voting Phase should any non-authorized
intervention, network failure, information storage failure, telecommunications
failure, malfunction, or other causes beyond its control, corrupt or impair the
security, administration, fairness and/or operation of this Contest as
determined by WSPA in its sole discretion. In such an
event, WSPA reserves the right to select the
Wedding Couple in the manner it deems fair in light of the circumstances and
the number of non-suspect votes received.
Upon the conclusion of the Public Voting Phase, the voting results will be tabulated
for each Finalist Couple and will count for sixty percent (60%) of the final
score to determine the Wedding Couple. The scores received from the Contest
Judges during the Panel Judging Phase will count for forty percent (40%) of the
final score. Subject to verification of continuing eligibility and compliance
with these Official Rules, the Finalist Couple with the highest combined score from the Public
Voting Phase and the Panel Judging Phase will be declared the grand prize
Wedding Couple.
VII. WEDDING
ELEMENT SELECTION PHASE
A. Announcement of Wedding Couple: On or
about May 9, 2011, the identity of the Wedding Couple will be announced on Your
Carolina. The announcement date is subject to change at WSPA’s sole
discretion. The Wedding Couple may be asked to provide WSPA with valid identification and execute an affidavit of eligibility or declaration
and, where legal, a publicity release, and return these documents within two (2)
days of notification. Wedding Couple is responsible
for all federal, state and local taxes and will be required to complete IRS Forms
W-9 prior to, and as a condition of, receiving any portion of the Grand Prize.
Wedding Couple may also be required to sign other legal documents, including
tax forms and a release supplied by WSPA
which, among other disclaimers, releases Sponsors and a range of subsidiaries,
directors, agents, agencies, affiliates, franchisees, promoters, officers,
directors, employees and related persons from any and all liability related to
this Contest and the receipt and use of the Grand Prize.
In the
event that the potential Wedding Couple (a) cannot be contacted directly by
WSPA within two (2) days from initial attempted notification, (b) fails to
satisfy any eligibility or verification requirement herein, (c) declines to
participate further in the Contest, (d) or is otherwise determined to be ineligible,
WSPA in its discretion may disqualify that Wedding Couple and the runner-up Finalist
Couple will be declared the alternate Wedding Couple as soon as reasonably
practicable after initial Wedding Couple is determined to be ineligible. Alternate Wedding Couples are subject to all
eligibility requirements and restrictions of these Official Rules.
B. Wedding Couple Obligations: In addition to the Finalist Couple
obligations above, the Wedding Couple must be willing, without additional
compensation:
- to accept
choices made by WSPA viewers, website visitors and others (and without
input from the Wedding Couple) as to the elements of the wedding set out
in the Wedding Elements Chart below;
- to make
themselves available to attend fittings and other wedding preparations and
to engage in public appearances and in photo shoots, as needed by WSPA;
- to ensure
that all legal requirements for their marriage (such as license, blood
tests, etc.) have been completed in a timely manner and at their sole
expense; and
- to be
legally married in a wedding ceremony that may videotaped for subsequent broadcast
on television by WSPA.
C. Disqualification/Selection of Alternate Wedding
Couple: If the Wedding Couple is disqualified or otherwise unable to
fulfill its obligations as outlined in these Official Rules, the Wedding Couple
will be disqualified and will forfeit the Grand Prize, in which event the first
runner-up Finalist Couple will be declared the Alternate Wedding Couple. The
Alternate Wedding Couple will be subject to all eligibility requirements in
these Official Rules. If WSPA is unable to confirm the eligibility of
any of the Finalist Couples, the Grand Prize will not be awarded. All
decisions of the judges are final and entrants agree to be bound by these decisions.
D. Public Voting on Wedding Elements: Starting on May 9, 2011 through
June 17, 2011, WSPA will feature on http://wspa.upickem.net/engine/Details.aspx?PageType=VOTING&contestid=28383
a number of choices for each of the elements of the wedding prizes to be
awarded, as set forth in the following Wedding Elements Chart (“the Wedding Elements”):

During the Wedding Elements Selection Phase, Voters may visit http://wspa.upickem.net/engine/Details.aspx?PageType=VOTING&contestid=28383
starting at 10:00 a.m. ET on the first day of the Voting Period and ending at
12:01 p.m. ET on the last day of the Voting Period to view the featured Wedding
Elements and vote for their choice for each Wedding Element. After the conclusion of each Voting Period during the Wedding Elements Selection Phase as
set out in the Wedding Elements Chart above, the voting results for the relevant Wedding
Element will be tabulated and the choice that receives the highest number of
votes will be declared an element of the Grand Prize. In the event of a tie, public
voting for the relevant Wedding Element will be extended for additional twenty-four
(24) hour voting periods until the tie is resolved.
WSPA reserves the right to disqualify
any votes that it reasonably believes to have been fraudulently cast. WSPA reserves the right to cancel, terminate or suspend this
Wedding Elements
Selection Phase should

light of the circumstances and the number of non-suspect votes received.
THE WEDDING COUPLE MUST AGREE NOT TO DISCLOSE PUBLICLY THEIR PREFERRED
CHOICES OR TO OTHERWISE ATTEMPT TO INFLUENCE OR MANIPULATE VIEWERS’ VOTES FOR
ANY OF THE ELEMENTS OF THE WEDDING.
VII. MISCELLANEOUS
A. Termination/Postponement: WSPA
reserves the right to postpone or terminate the Contest or any component
thereof, including without limitation, any part of the Entry Phase, the Panel
Judging Phase, the Public Voting Phase, and the Wedding Element Selection Phase,
should any non-authorized intervention, network failure, information storage
failure, telecommunications failure, malfunction, or other causes beyond its
control, corrupt or impair the security, administration, fairness and/or operation
of this Contest as determined by WSPA in its sole discretion. In such an
event, WSPA will select the Finalist Couple, Wedding Couple or Wedding Element,
as applicable, from all non-suspect, eligible entries or featured wedding
elements, utilizing the selection process and judging criteria set forth above
or otherwise in the
manner WSPA deems fair in light of the circumstances.
B. No Liability for Errors, etc.: Entrants agree that Sponsors and a
range of subsidiaries, directors, agents, agencies, affiliates, franchisees,
promoters, officers, directors, employees and related persons (a) are not
responsible for technical failures of any kind, including but not limited to
lost, disconnected, interrupted, or unavailable network, server, or other
connections, late, lost, undeliverable, damaged or
stolen mail, or for any failed telephone or computer hardware or
software, or for any failed, delayed, misdirected, corrupted, or garbled
transmissions or errors of any kind, whether human, mechanical, or electronic,
or for entries or votes that for any reason are not received by WSPA by the deadlines stated above; (b)
are not responsible for any incorrect or
inaccurate information, whether caused by entrants, Voters, printing,
typographical or other errors or by any of the equipment or programming
associated with or utilized in the Contest or in the printing of this offer,
administration of this Contest, or in the announcement of the prizes; (c)
are not responsible for any injury or damage to any computer, modem or other
electrical device as a result of participation in this Contest or in the Entry
Phase, Panel Judging Phase, Public Voting Phase, or Wedding Elements Selection
Phase, or downloading of any software or materials; (d) are not responsible for
unauthorized human intervention in any part of the
Contest, including without limitation, the Entry Phase, Panel Judging
Phase, Public Voting Phase, or Wedding Elements Selection Phase; (e) are not responsible for any printing, typographical, technical, computer, network or
human error that may occur in the administration of the Contest, the uploading,
the processing or judging of entries or votes or the tabulating of Votes, the
announcement of the Finalists, the Wedding Couple, or the Wedding Elements or
Grand Prize or otherwise in any Contest-related materials; (f) are not
responsible for any unauthorized third party use
of any entry (including any Submission Materials); (g) are not responsible
for the inability to select Finalists, the Wedding Couple or any Wedding Element
because of postal failure, equipment failure, or data storage failure; and (h)
are released from any and all alleged, existing, or future actions, claims,
and/or liabilities of whatever nature including, but not limited to, personal
injury, bodily injury (including, without limitation, wrongful death and
disability), property damage, and expense (including,
without limitation, reasonable attorneys’ fees) and loss or damage of
any other kind, arising in whole or in part directly or indirectly, from participating and/or voting in the Contest
(in whole or in part), the use (including modification, adaptation, and
reproduction) of entries (including any Submission Materials) during or after
the Contest, and the delivery, acceptance, possession, use, misuse, loss,
or misdirection of any prize element.
C. Disclaimer of Warranties: SPONSORS AND
THEIR SUBSIDIARIES, AFFILIATES, AGENTS, DISTRIBUTORS, RETAILERS, AND ALL OF
THEIR RESPECTIVE ADVERTISING AND PROMOTIONAL AGENCIES, REPRESENTATIVES,
EMPLOYEES, CONTRACTORS, OFFICERS, DIRECTORS, AND AGENTS (COLLECTIVELY, THE
"RELEASED PARTIES") EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY
KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT
LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR
RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS,
PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO THE PRIZE.
UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR
YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE
THROUGH THE CONTEST OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR
ERRONEOUS PARTICIPATION, AWARD OF PRIZE OR OTHER BENEFITS UNDER THESE OFFICIAL
RULES. RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE
CONTEST OR RELATED WEBSITES WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT
GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE
CONTEST. RELEASED PARTIES WILL NOT BE LIABLE, AND ARE NOT RESPONSIBLE, FOR
DAMAGES OF ANY KIND RELATED TO YOUR PARTICIPATION IN OR INABILITY TO
PARTICIPATE IN THE CONTEST, WHETHER THE DAMAGES ARE DIRECT, INDIRECT,
INCIDENTAL, SPECIAL OR CONSEQUENTIAL.
D. No Liability for Certain Damages: BY
ENTERING THE CONTEST AND/OR ACCEPTING A PRIZE, YOU AGREE THAT THE RELEASED
PARTIES SHALL NOT BE LIABLE FOR, AND WILL BE HELD HARMLESS BY YOU AGAINST, ANY
LIABILITY FOR ANY DAMAGE, INJURY OR LOSS TO PERSON (INCLUDING DEATH) OR
PROPERTY RELATED IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, TO ACCEPTANCE,
POSSESSION, USE OR MISUSE OF PRIZE, PARTICIPATION IN ANY PRIZE-RELATED OR
CONTEST-RELATED ACTIVITY, USE BY A RELEASED PARTY OF ANY ENTRY, PARTICIPATION
IN THE CONTEST, OR ANY OTHER CLAIM OR CAUSE OF ACTION YOU MAY HAVE AGAINST A
RELEASED PARTY.
SOME STATES
DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR
CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO
YOU IN WHOLE OR IN PART.
E. Tampering/Disqualification of Voters or Entrants: WSPA
reserves, at any
time prior to the final award of the Grand Prize, the right to prohibit any entrant
or Voter from participating in the Contest, including the Entry Phase, Panel
Judging Phase, Public Voting Phase, or Wedding Elements Selection Phase, if, at
WSPA’s sole discretion, it finds such entrant
or Voter to be colluding to unfairly affect the outcome of any aspect or phase of
the Contest, or to be tampering with the entry process or the Entry Phase, Public
Voting Phase, or Wedding Elements Selection Phase or the operation of the
Contest in any other way, or if such entrant or Voter repeatedly shows a
disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner WSPA determines to be not fair or
equitable; (b) with an intent to annoy, threaten or harass any other entrant,
Voter or Sponsors; or (c) in any other disruptive manner. Any person
attempting to defraud or tamper with any part of this Contest in any way will
be ineligible for prizes and may be prosecuted to the full extent of the law.
Any failure by the WSPA to enforce any of these Official
Rules shall not constitute a waiver of such Official Rules. CAUTION: ANY ATTEMPT BY ANY
INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY
BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WSPA RESERVES THE RIGHT TO SEEK DAMAGES
FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
F. Verification: All activity arising out of
and relating to the Contest is subject to verification and/or auditing for
compliance with the Official Rules and you agree to cooperate with WSPA concerning verification and/or auditing. All references
to an entrant's status as a "Finalist” or “Wedding Couple" are
subject to verification and/or auditing by WSPA.
If verification activity or an audit evidences non-compliance of an entry or
entrant with the Official Rules as determined by WSPA in its sole discretion, WSPA
reserves the right to disqualify the entrant and remove the entry from the
Contest at any time.
G. Typographical/Clerical Errors: WSPA reserves the right to correct
typographical, printing or clerical errors in any Contest-related materials.
No more than the stated number of prizes and/or prize elements will be awarded.
In the event that production, technical, seeding, programming or any other
reasons cause more than the stated number of prizes and/or prize elements as
set forth in these Official Rules to be available and/or claimed, WSPA reserves the right to award only the stated number
of prizes and/or prize elements by selecting the Wedding Couple and/or Wedding
Elements from all legitimate, un-awarded, eligible prize claims in accordance
with the previously announced selection Judging Criteria.
VIII. DISPUTES
By entering
the Contest and/or participating in the Public Voting Phase or Wedding Elements
Selection Phase, entrants and Voters agree that (a) any and all disputes, claims,
and causes of action arising out of or connected with the Contest, including
the Entry Phase, Public Voting Phase, and Wedding Elements Selection Phase, or
any prizes awarded, shall be resolved individually, without resort to any form
of class action; (b) any and all claims, judgments and awards shall be limited
to actual out-of-pocket costs incurred, including costs associated with
entering and/or participating in the Contest including the Entry Phase, Public
Voting Phase, and Wedding Elements Selection Phase, or any prizes awarded, but
in no event attorneys' fees; and (c) under no circumstances will any entrant or
Voter be permitted to obtain any award for, and each entrant and Voter hereby
waives all rights to claim punitive, incidental or consequential damages and
any and all rights to have damages multiplied or otherwise increased and any
other damages, other than for actual out-of-pocket expenses, and any and all
rights to have damages multiplied or otherwise increased. Some jurisdictions
do not allow for limitations on the ability to pursue class action remedies, or
certain kinds of damages, and so these limitations may not apply to you.
By entering
the Contest and/or participating in the Public Voting Phase or Wedding Elements
Selection Phase, entrants and Voters agree that all issues and questions concerning the construction,
validity, interpretation and enforceability of these Official Rules, or the
rights and obligations of the entrants, Voters and WSPA in connection with the
Contest, shall be governed by, and construed in accordance with the laws of the
State of South Carolina, without giving effect to any choice of law or conflict
of law rules or provisions that would cause the application of the laws of any
jurisdiction other than the State of South Carolina. Any legal proceedings
arising out of this Contest or relating to these Official Rules shall be instituted only in the federal or
state courts located in the State of South Carolina, County of Spartanburg,
and the parties consent to jurisdiction therein with respect to any legal
proceedings or disputes of whatever nature arising under or relating to these Official Rules. The invalidity or unenforceability
of any provision of these Official Rules shall not affect the validity or
enforceability of any other provision. In the event that any provision is
determined to be invalid or otherwise unenforceable or illegal, these Official
Rules shall otherwise remain in effect and be construed in accordance with
their terms as if the invalid or illegal provision were not contained herein.
IX. PUBLICITY RELEASE
Acceptance
of any prize constitutes permission (except where prohibited by law) to use
entrant’s name, city, state, likeness and/or voice for purposes of advertising,
promotion and publicity without additional compensation.
X. DISCLAIMER/LIMITATION OF LIABILITY
All
entrants and participants assume all liability for any injury or damages caused
or claimed to be caused by their participation in the Contest, including the
acceptance, use and enjoyment of any Prize. All entrants and participants
release Sponsors and their respective advertising and promotion agencies, their
parent, subsidiary, affiliate and joint venture companies, as well as their
respective officers, directors, and employees, from any such liability. Sponsors
and their respective advertising and promotion agencies, their parent,
subsidiary, affiliate and joint venture companies, as well as their respective
officers, directors, and employees assume no responsibility for any injury or
damage to entrant’s or to any other person’s computer relating to or resulting
from entering or downloading materials or software. Sponsors and their
respective advertising and promotion agencies, their parent, subsidiary,
affiliate and joint venture companies, as well as their respective officers,
directors, and employees are not responsible for technical, hardware, software,
or telephone malfunctions of any kind, lost or unavailable network connections,
or failed incorrect, incomplete, inaccurate, garbled or delayed electronic
communications caused by the user or by any of the equipment or programming
associated with or utilized in this Contest or by any human error which may
occur in the processing of the entries in this Contest.
